2. PURPOSE

These General Terms and Conditions of Sale (GTCS) govern the sales concluded between the Seller and any natural or legal person making a purchase on the Eurl Le Comptoir des Régions website https://www.lecomptoirdesregions.fr.

Any order implies full, complete, and unreserved acceptance of these GTCS.

 

 

3. PRODUCTS

The products offered for sale are primarily:

  • French regional products,

  • Gourmet groceries (épicerie fine),

  • Beverages,

  • Teas and coffees,

  • Artisanal products,

  • Gifts,

  • Food products,

  • Alcoholic beverages.

The products are described with the greatest possible accuracy.

Photographs, visuals, and descriptions have no contractual value.

Artisanal products may show minor variations in color, packaging, or presentation.

 

 

4. AVAILABILITY

Products are offered subject to availability.

In the event of unavailability after order validation, the customer will be informed as soon as possible.

The customer may then choose:

  • A refund,

  • A credit note,

  • Or an equivalent replacement product.

 

5. PRICES

The prices displayed on the site are expressed in euros (€).

For sales bound for France and the European Union, prices are displayed inclusive of all taxes (VAT included) according to applicable French regulations.

The Seller reserves the right to modify its prices at any time.

However, products will be billed based on the rates in effect at the time of order validation.

Delivery costs are specified before the final validation of the order.

 

 

6. VAT AND SALES WITHIN THE EUROPEAN UNION

Sales made to individuals within the European Union are subject to European regulations applicable to distance selling.

The Seller applies French VAT as long as the applicable European thresholds are not exceeded.

The Seller may apply the destination country's VAT under the OSS (One Stop Shop) scheme in accordance with European regulations.

For sales to professionals with a valid intra-community VAT number, VAT-exempt invoicing may be applied in accordance with current tax rules.

 

 

7. ORDERING

The customer can place an order directly on the website.

Any order implies acceptance of the prices, product descriptions, and these GTCS.

The Seller reserves the right to refuse or cancel an order in the event of:

  • A prior dispute,

  • Payment default,

  • Suspicion of fraud,

  • Incorrect information,

  • Or an abnormal request.

 

8. SALE OF ALCOHOL

In accordance with Article L3342-1 of the French Public Health Code, the sale of alcohol to minors under 18 years of age is prohibited.

By confirming their order, the customer certifies that they are of the required legal age in their country of residence to purchase and consume alcoholic beverages.

Alcohol abuse is dangerous to your health. Consume in moderation.

The Seller reserves the right to refuse any order containing alcohol if there is any doubt about the customer's age.

 

 

9. PAYMENT

Payment for purchases is due in full at the time of ordering.

The accepted payment methods are those offered on the website.

Payments are secured via the Seller's partner payment solutions.

The Seller reserves the right to suspend any order in the event of refused bank authorization or non-payment.

 

 

10. DELIVERY

Areas Served

The Seller delivers:

  • To metropolitan France,

  • To European Union countries.

Certain destinations may be excluded depending on:

  • Local regulations,

  • Customs restrictions,

  • Carrier limitations,

  • Or constraints related to the shipping of alcohol.

    Delivery Methods

    Deliveries may be made notably via:

  • Chronopost,

  • Mondial Relay,

  • In-store pickup.

The delivery method is chosen by the customer when ordering.

Delivery Times

Delivery times are provided as an estimate.

The Seller cannot be held responsible for delays related to:

  • Carriers,

  • Strikes,

  • Weather conditions,

  • Customs checks,

  • Or any force majeure event.

    Receipt of Packages

    The customer must check the condition of the package upon receipt.

    Any anomaly (damaged package, broken product, leak, missing product) must be:

  • Reported immediately to the carrier,

  • Noted as specific reservations,

  • And then notified to the Seller within 48 hours, accompanied by photographs.

No claim will be accepted without explicit reservations made to the carrier.

 

11. EXPORT – CUSTOMS – CUSTOMER RESPONSIBILITY

The customer is responsible for verifying that the ordered products are authorized in their destination country.

The Seller cannot be held liable for:

  • An import refusal,

  • Customs seizure,

  • Local taxation,

  • Prohibitions related to food or alcoholic products,

  • Or delays caused by customs authorities.

Any potential customs duties, local taxes, import fees, or customs clearance fees remain the exclusive responsibility of the customer.

 

12. RIGHT OF WITHDRAWAL

In accordance with current European regulations, the customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal.

To exercise this right, the customer must contact the Seller at the following address:

The products must be returned:

  • Complete,

  • Unopened,

  • Unused,

  • In their original packaging.

Return shipping costs remain the responsibility of the customer.

Exceptions to the Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:

  • Perishable goods,

  • Opened food products,

  • Unsealed products,

  • Personalized products,

  • Opened alcoholic beverages,

  • Digital content supplied immediately.

     

13. RETURNS AND REFUNDS

After receipt and verification of the returned products, the refund will be issued via the payment method used during the order.

The refund may be refused if the product is:

  • Incomplete,

  • Opened,

  • Used,

  • Damaged,

  • Or unfit for resale.

     

14. LIABILITY

The Seller cannot be held liable for:

  • Improper use of the products,

  • Non-compliance with the local regulations of the customer's country,

  • Delivery delays attributable to the carrier,

  • A force majeure event,

  • Or indirect damage.

     

15. FORCE MAJEURE

The execution of the Seller's obligations will be suspended in the event of a force majeure occurrence as defined by French case law.

The following are notably considered as force majeure events:

  • Natural disasters,

  • Fires,

  • Floods,

  • Strikes,

  • Wars,

  • Pandemics,

  • Interruption of transport or telecommunication networks.

    16. PERSONAL DATA – GDPR

    The personal data collected is used solely for the purposes of:

  • Order processing,

  • Customer relations,

  • Sending commercial information,

  • And legal obligations.

The Seller commits to complying with the General Data Protection Regulation (GDPR).

The customer has the following rights:

  • Access,

  • Rectification,

  • Deletion,

  • Restriction,

  • Opposition,

  • Portability.

19. APPLICABLE LAW AND DISPUTES

These General Terms and Conditions of Sale are subject to French law.

In the event of a dispute, an amicable solution will be sought as a priority.
